1. Overview

Comistitch respects the intellectual property rights of others and expects users of our platform to do the same. This Copyright Policy outlines how we handle claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and applicable international copyright laws.

If you believe that content hosted on Comistitch infringes your copyright, please follow the procedure described below to submit a takedown notice.

2. User Responsibilities

Users are solely responsible for ensuring that the content they create, upload, or publish through Comistitch does not infringe the copyright, trademark, or other intellectual property rights of any third party.

You may not use Comistitch to generate content that reproduces recognizable copyrighted characters, logos, or brand imagery without proper authorization from the rights holder.

You may not deliberately prompt the AI to replicate the distinctive artistic style of an identifiable living artist. Doing so may result in content removal and account suspension.

3. Filing a Copyright Complaint

If you believe that content on Comistitch infringes your copyright, please send a written notice to support@comistitch.com containing the following information:

(a) Your full legal name and contact information (email address, mailing address, and phone number).

(b) A description of the copyrighted work you believe has been infringed.

(c) The URL or specific location of the infringing content on Comistitch.

(d) A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

(e) A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

(f) Your physical or electronic signature.

4. How We Handle Complaints

Upon receiving a valid copyright infringement notice, Comistitch will: (1) Review the complaint for completeness and validity. (2) Temporarily remove or disable access to the allegedly infringing content. (3) Notify the user who created or uploaded the content. (4) Take appropriate further action, which may include permanent content removal or account suspension.

We aim to acknowledge all valid complaints within 3 business days and take action within 7 business days.

5. Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may submit a counter-notification to support@comistitch.com containing:

(a) Your name, address, and phone number. (b) Identification of the content that was removed and its location before removal. (c) A statement under penalty of perjury that you believe the content was removed by mistake or misidentification. (d) Your consent to the jurisdiction of the federal court in your district. (e) Your physical or electronic signature.

If we receive a valid counter-notification, we may restore the content within 10–14 business days unless the original complainant files a court action.

6. Repeat Infringers

Comistitch maintains a policy of terminating the accounts of users who are found to be repeat infringers. A user who receives three valid copyright complaints within a 12-month period may have their account permanently suspended.

We reserve the right to terminate any account at our sole discretion if we determine that a user has engaged in a pattern of copyright infringement.

7. AI-Assisted Content Disclaimer

Content created with AI assistance may unintentionally resemble existing copyrighted works. Comistitch does not guarantee that AI-assisted outputs are free from potential copyright concerns.

Users are responsible for reviewing their content before publishing or distributing it. If you discover that content created with AI assistance resembles a copyrighted work, please refrain from publishing it and report the issue to support@comistitch.com.
