1. Acceptance of Terms

By accessing or using Comistitch, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the service.

We reserve the right to update these terms at any time. Continued use of the service after changes are posted constitutes acceptance of the revised terms. Material changes will be communicated via email to registered users.

2. Service Description

Comistitch is an AI-assisted comic creation platform that helps users create comic pages from story prompts. The service includes character management, script analysis, AI-powered creative assistance, and image export functionality.

The platform operates on a credit-based system where each comic page generation consumes a defined number of credits from your account balance.

3. Account Registration and Security

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately at support@comistitch.com if you suspect unauthorized access to your account. Comistitch is not liable for losses arising from unauthorized use of your credentials.

4. Credit System and Payments

Credits are purchased through subscription plans processed by our merchant of record partner. Each comic page creation consumes 30 credits from your account balance.

Credits are non-refundable and non-transferable. Unused credits do not roll over between billing cycles unless explicitly stated in your plan terms. Subscriptions auto-renew at the end of each billing period unless cancelled.

You may cancel your subscription at any time through the account settings or the billing customer portal. Cancellation takes effect at the end of the current billing period; no prorated refunds are issued for partial periods.

5. Content Ownership & Rights

You own all comic pages and images created through Comistitch using your prompts and characters. Comistitch does not claim ownership or licensing rights over your creative outputs.

By submitting content to the platform, you grant Comistitch a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating, maintaining, and improving the service.

You are solely responsible for ensuring that your story prompts, character descriptions, and creative outputs do not infringe the intellectual property rights of any third party. Comistitch is not liable for claims arising from user-submitted content.

6. Acceptable Use

You may not use Comistitch to generate content that: is sexually explicit; depicts minors in inappropriate situations; promotes violence, hatred, or illegal activity; infringes on trademarks, copyrights, or other intellectual property rights; uses recognizable characters, brands, or copyrighted works without authorization; or deliberately mimics the distinctive style of identifiable living artists.

You may not attempt to reverse-engineer, decompile, or extract the source code of the platform. Automated access (scraping, bots) is prohibited without prior written consent.

Violation of this acceptable use policy may result in immediate account suspension or termination without refund of remaining credits.

7. Content Moderation & Enforcement

Comistitch strictly prohibits the generation, publication, or distribution of the following content categories: sexually explicit or pornographic material (NSFW); content depicting minors in sexual, abusive, or otherwise inappropriate situations (CSAM); non-consensual intimate imagery or synthetic deepfakes of real individuals; extreme graphic violence, gore, torture, or mutilation; content promoting terrorism, self-harm, or suicide; hate speech targeting race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics; content designed to harass, bully, stalk, or threaten individuals.

We enforce these prohibitions through multiple technical layers: (1) Automated client-side screening that detects prohibited keywords and patterns before submission; (2) Server-side content validation that analyzes all prompts before they reach our AI-powered creative tools; (3) AI provider safety filters — our AI provider applies its own content safety filters configured to the strictest available threshold, blocking harmful content at the model level; (4) Community reporting — all published comics include a report button allowing any visitor to flag content for review; (5) Violation logging — every policy violation is recorded with an audit trail for compliance purposes.

When a content policy violation is detected, the following progressive enforcement actions apply: First violation — the request is blocked and a warning is issued to the user's account. Second violation — account is suspended for 7 days. Third violation — permanent account termination without refund of remaining credits. For severe violations involving child exploitation material (CSAM), non-consensual intimate imagery, or content promoting terrorism, immediate permanent termination applies without prior warning.

As part of our compliance with payment processor and card network requirements, Comistitch cooperates fully with our merchant of record partner, Visa, Mastercard, and other payment networks to ensure content created on our platform meets their acceptable use standards. We reserve the right to review, remove, or restrict access to any content at our sole discretion.

Users may report content that violates this policy by using the report button on any published comic page or by contacting support@comistitch.com. We aim to review all reports within 48 hours and take appropriate action.

8. Intellectual Property

The Comistitch name, logo, website design, and platform source code are the exclusive property of Comistitch and are protected by applicable intellectual property laws.

User-generated content (comics, characters, prompts) remains the property of the user. By publishing content to the community gallery, you grant Comistitch a non-exclusive license to display that content on the platform.

9. Free User Watermark

Comic pages generated under the free plan include a small Comistitch watermark on exported images. The watermark is applied at export time and does not alter the stored original.

Upgrading to any paid subscription plan removes the watermark from all future exports. Previously exported images with watermarks can be re-downloaded watermark-free after upgrading.

10. Service Availability

Comistitch is provided on an 'as is' and 'as available' basis. We do not guarantee uninterrupted or error-free operation. AI-powered features depend on third-party providers and may be temporarily unavailable.

We will make reasonable efforts to maintain service uptime and notify users of planned maintenance. However, we are not liable for any loss or damage resulting from service interruptions.

11. Termination

Comistitch may suspend or terminate your account at any time for violation of these Terms of Service, with or without prior notice. Upon termination, your right to use the service ceases immediately.

You may delete your account at any time through the account settings page. Upon deletion, your data will be removed in accordance with our Privacy Policy. Remaining credits are forfeited upon account termination.

12. Disclaimer of Warranties

The service is provided without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI-assisted outputs may vary in quality and accuracy. Comistitch does not guarantee that content created with AI assistance will meet your specific expectations or requirements.

13. Limitation of Liability

To the maximum extent permitted by law, Comistitch's total liability for any claims arising from or related to the service is limited to the subscription fees you paid in the three months preceding the claim.

In no event shall Comistitch be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, even if advised of the possibility of such damages.

14. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from or related to these terms or the service shall be resolved through binding arbitration administered by the American Arbitration Association. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.
